3 MONTH PLAN

By purchasing membership you are agreeing to the following terms:

 

I plan to participate in the fitness class at SMARTFIT BY BRIAN. Waiver and Release I am fully aware of all of the risks involved in participating in the event and its activities. I voluntarily agree to take on these risks. I am solely responsible for judging my own qualifications and for my own safety during the classes and while using any provided equipment, materials or supplies. I am solely responsible for determining and assessing my health, including both my physical and mental condition. I do not suffer from any medical condition or disease that might in any way hinder or prevent me from fully participating in the fitness class. I am qualified to use the equipment provided. I am fully aware of all of the risks of strenuous physical activity, which could include stretching, running, lifting heavy objects (including lifting heavy objects above one’s head), anaerobic exercise, aerobic exercise as well as many other activities that I will perform while working out with SMARTFIT BY BRIAN coaches and trainers. I do not suffer from any medical condition or disease that may in any way hinder or prevent me from fully participating in physical activity. I have fully disclosed all pertinent medical and physical conditions to SMARTFIT BY BRIAN prior to signing this waiver. I have had the opportunity to consult with my primary care physician prior to participating in this fitness program with SMARTFIT BY BRIAN. I hereby knowingly and intentionally waive any and all claims against SMARTFIT BY BRIAN arising from or relating to my participation in activities conducted by SMARTFIT BY BRIAN SMARTFIT BY BRIAN. In return for the being allowed to participate, I release, discharge and agree to hold harmless SMARTFIT BY BRIAN, any person, company or organization providing services or equipment in connection with the event, and their employees, sponsors, agents and volunteers from any and all liability that may arise, directly or indirectly, now or in the future, by reason of any injury, damage, loss or expense incurred in connection with my participation, even if caused solely or in part by the fault of SMARTFIT BY BRIAN or the other persons, companies or organizations released. “Fault” includes, but is not limited to negligence, gross negligence and/or recklessness. This release is a binding legal document. SMARTFIT BY BRIAN and the other persons, companies or organizations released will have the legal right to rely fully on all statements, agreements and promises that I make in this release. The release is binding on my executors, administrators, successors and assigns, as well as upon me.
